By accessing or using the Service, creating an account, purchasing tokens, enabling device permissions (including camera or microphone), or interacting with AI features, you agree to be legally bound by these Terms and our Privacy Policy.

1. Eligibility

The Service is strictly limited to individuals who are at least 18 years old.

By using the Service, you represent and warrant that:

You are at least 18 years old;
You have full legal capacity to enter into binding agreements;
Your use of the Service does not violate any applicable laws.

2. Account Registration and Security

You are responsible for maintaining the confidentiality of your credentials.
You are fully responsible for all activities conducted under your account.
You must immediately notify us of unauthorized access or security breaches.

We reserve the right to suspend, restrict, or terminate accounts at our sole discretion for security risks, violations, fraud, abuse, or legal exposure.

3. Token System

The Service operates through a digital token-based access system.

Tokens are required to access certain AI and platform features.
Token pricing, availability, and consumption logic may change at any time.
Tokens are non-transferable and non-assignable.
Except where required by law, tokens are non-refundable.
Tokens have no monetary value outside the Service.

We reserve the right to modify token rules, adjust usage thresholds, prevent abuse, and revoke tokens obtained through fraud or policy violations.

4. Payments and Chargeback Policy

Payments are processed by authorized third-party providers. We do not store full payment card numbers or sensitive financial credentials.

Anti-Chargeback & Fraud Policy

You agree not to initiate fraudulent chargebacks or payment disputes.

In case of chargebacks, reversals, or suspected fraudulent behavior, we reserve the right to:

Suspend or permanently terminate your account;
Remove or invalidate credited tokens;
Recover outstanding balances;
Report fraudulent activity to financial institutions or authorities;
Pursue civil or criminal legal remedies.

5. Camera, Media, and Device Permissions

The Service may allow you to enable device permissions such as camera, microphone, or file uploads.

You control whether to grant device permissions.
We do not access camera or microphone without your authorization.
You are solely responsible for content captured, uploaded, or transmitted.

You represent and warrant that you have all necessary rights and permissions to upload or transmit any media content and that such content does not violate any laws or third-party rights.

6. Acceptable Use

You agree not to:

Violate any applicable laws or regulations;
Exploit or manipulate the token system;
Interfere with infrastructure or security mechanisms;
Upload malicious code or harmful content;
Attempt to reverse engineer, decompile, or replicate the Service;
Use automated bots or scraping tools without authorization;
Use the Service for unlawful, abusive, or harmful activities.

7. AI-Generated Content Disclaimer

The Service uses artificial intelligence systems to generate outputs.

AI outputs may be inaccurate, incomplete, biased, or misleading.
Outputs are provided strictly "AS IS".
AI-generated content does not constitute legal, financial, medical, or professional advice.

You assume full responsibility for how you use or rely upon AI-generated content.

8. Intellectual Property

All intellectual property rights in the Service, including software, branding, design, algorithms, and infrastructure, remain the exclusive property of JARNAZI OU.

No rights or licenses are granted except as expressly provided in these Terms.

9. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis.

To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, statutory, or otherwise, including merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the maximum extent permitted by law, JARNAZI OU shall not be liable for:

Indirect, incidental, special, consequential, or punitive damages;
Loss of profits, revenue, data, goodwill, or business opportunities;
Service interruptions or data loss;
Reliance on AI-generated content;
User-generated or uploaded content.

Our total aggregate liability shall not exceed the amount paid by you in the three (3) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless JARNAZI OU, its officers, directors, employees, and affiliates from any claims, damages, liabilities, losses, or expenses arising from:

Your misuse of the Service;
Your violation of these Terms;
Your uploaded or captured media content;
Your violation of third-party rights.

12. Termination

We may suspend or terminate your access without prior notice if you violate these Terms or if your activity creates legal, financial, or security risk.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Estonia, without regard to conflict of law principles.

14. Arbitration and Dispute Resolution

Any dispute arising from or relating to these Terms shall be resolved through binding arbitration conducted on an individual basis in Estonia.

You waive participation in class actions.
You waive participation in class arbitration.
You waive the right to act as representative plaintiff.

15. Force Majeure

We are not liable for delays or failures caused by events beyond reasonable control, including cyberattacks, infrastructure failures, governmental actions, natural disasters, or outages.

16. Modifications to Service or Terms

We may modify the Service or update these Terms at any time. Continued use after updates constitutes acceptance of the revised Terms.
